Terms and Conditions

§1.

OHANA Surf & Retreat Experiences (“OHANA Experiences”) are multi-day

surf training programs operated in collaboration with different independent

service providers depending on the destination.

Accommodation and hospitality services are provided by OHANA WAVES

(Private Limited), Sri Lanka (Company Registration No:00346444, Registered

Address: Denuwala Road, Midigama), or other local accommodation providers

where applicable.

Surf coaching, yoga, and related activities are delivered by independent third-

party instructors and surf schools acting under their own legal responsibility.

Program coordination and experience management are provided by Magdalena

Szymaniak (ENI, Portugal, NIF: 311121659), acting as independent

contractor.

§2.

The following are mandatory conditions for participation in the OHANA Surf

Camp project:

– Participants must be at least 18 years old

-Participants must disclose any medical conditions or injuries that could affect their safe participation

§3.

Booking is considered confirmed upon receipt of the required deposit via WeTravel booking system.

Only after this condition is met does a binding agreement between the

participant and OHANA come into effect.

§4.

Each Experience may include surf coaching, yoga, accommodation, meals,

transport, and additional activities as specified in the individual offer.

The exact scope of services depends on the location and program.

The organizer reserves the right to modify the schedule or activities due to

weather, safety or operational reasons.

§5.

Participants confirm they are physically and mentally fit to participate.

Participants must arrange their own travel/recreational insurance covering

surfing activity for the camp duration or/and possess a valid European Health

Insurance Card.

Any medical conditions must be disclosed prior to participation.

§6.

By participating in the camp, the participant agrees to:

– Being photographed and filmed during the camp

– The free, irrevocable and unlimited use of photos and videos for

marketing and promotional purposes.

– Publishing photos/videos on various platforms, including: The Ohana

Surf Camp website, Facebook, YouTube, Instagram, TikTok etc.

§7.

Participants acknowledge that services are provided by independent third

parties.

Each provider is solely responsible for the services they deliver.

OHANA is not responsible for failures, delays or issues caused by third-party

providers.

§8.

OHANA is not responsible for loss, theft or damage of personal belongings.

§9.

Participants must:

– follow safety instructions

– respect staff, instructors and other participants

– respect local laws and regulations

Prohibited:

– illegal drugs

– behaviour that endangers safety

– Alcohol must not affect safety or participation.

OHANA reserves the right to remove any participant without refund in case of

unsafe or disruptive behaviour.

§10.

If a participant cancels more than 60 days before the camp:

Full refund of the deposit (299 EUR) or any other amount paid.

If a participant cancels less than 60 days before the camp:

The deposit is non-refundable.

§11.

OHANA may cancel or reschedule an experience due to:

• insufficient participation

• safety concerns

• force majeure

In such cases, participants will receive a refund of payments made.

§12.

Surfing is an extreme sport that involves risks such as human error,

unpredictable weather, strong winds, and other unforeseen natural factors.

Serious injuries or life-threatening accidents cannot be completely ruled out.

The organizer is not responsible for damages caused by force majeure or other

risks mentioned in this section.

§13.

To the maximum extent permitted by applicable law, OHANA shall not be held

liable for any injury, loss, damage, accident, delay or additional costs arising

from participation in the Experience, except in cases of proven gross negligence

or willful misconduct by OHANA.

OHANA’s total liability, in any circumstance, is limited to the total amount paid

by the participant for the specific Experience.

§14.

No refunds (full or partial) will be given if a participant attends only part of the

camp for reasons beyond the organizer’s control.

§15.

By booking and participating, the participant confirms that they have read,

understood, and accepted these Terms & Conditions.
